It was established in June 1945 by Charter of UN and began work in April 1946. The seat of the court is at the Peace Palace in the Hague, Netherland. Of the six principal organs of the UN, it is the one one that is not located in New York (USA).&nbsp;<\/p>\n\n\n\n<p style=\"font-size:18px ; text-align:justify\">It consists of 15 judges regardless of their nationality with every 5 judges elected every 3 years (tenure 9 years) by the UN General Assembly and the security council. Its official languages are English and French.&nbsp;<\/p>\n\n\n\n<p style=\"font-size:18px;text-align:justify\">As stated in the UN Charter, all 193 UN members are automatically parties to the courts\u2019 statute. Non &#8211; UN members may also become parties to the courts\u2019 statute. However, being a party to the statute does not give the court jurisdiction over disputes involving those parties.<\/p>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 style=\"font-size:16px\">Two Types of Jurisdiction :<\/h2>\n\n\n\n<div style=\"height:26px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p style=\"font-size:18px;text-align:justify\"><strong>(1) Contentious Jurisdiction &#8211; <\/strong> All the disputes of legal nature are submitted to it by member states. However, International Court Of Justice only has jurisdiction over any dispute if both concerned parties (states) submit to its jurisdiction. This can be done in 2 ways:<\/p>\n\n\n\n<p style=\"font-size:18px ; text-align:justify\">(A) Voluntary Jurisdiction &#8211; State consents to submit to ICJ\u2019s jurisdiction ( or accepts the jurisdiction of ICJ)<\/p>\n\n\n\n<p style=\"font-size:18px ; text-align:justify\">(B) Compulsory Jurisdiction &#8211; Under this, the jurisdiction of International Court Of Justice is mandated by a treaty, or by means of a unilateral declaration accepting the compulsory jurisdiction of International Court Of Justice (such declarations can be done and revoked at any time).<\/p>\n\n\n\n<p style=\"font-size:18px ; text-align:justify\"><strong>(2) Advisory Jurisdiction &#8211; <\/strong>Under this, the other arms of the UN or other international bodies can approach the court for a non-binding legal advisory opinion on a particular issue.<\/p>\n\n\n\n<p style=\"font-size:18px ; text-align:justify\">The court has no jurisdiction to deal with applications from individuals, NGO\u2019s, Corp or any private entity. Only states are eligible to appear in contentious cases.<\/p>\n\n\n\n<p style=\"font-size:18px ; text-align:justify\">So far 72 countries have accepted the compulsory jurisdiction. The list includes countries like India, Australia, Pakistan, United Kingdom of Great Britain, Japan, Marshall Islands, Mauritius, Germany, Switzerland etc.<\/p>\n\n\n\n<div style=\"height:32px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p style=\"font-size:16px\"><strong>For example &#8211; With respect to India:<\/strong><\/p>\n\n\n\n<p style=\"font-size:18px ; text-align:justify\">In 1974, India made a declaration by which it made the jurisdiction of ICJ ipso facto compulsory with certain reservations that excluded following categories of dispute:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><p style=\"font-size:18px\">DISPUTES with nations of the Commonwealth group<\/p><\/li><li><p style=\"font-size:18px\">DISPUTES related to acts in self-defence<\/p><\/li><\/ul>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The International court of justice (ICJ) is the principal judicial organ of the United Nations.&hellip;<\/p>\n","protected":false},"author":1,"featured_media":1205,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"content-type":"","_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[31],"tags":[37],"class_list":["post-1195","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-international-organisations","tag-international-court-of-justice"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>International Court Of Justice - Politics Science News<\/title>\n<meta name=\"description\" content=\"The International court of justice (ICJ) is the principal judicial organ of the United Nations.
